The intersection of employment and labor law and social media has presented many new issues, and some old issues with new twists, for the National Labor Relations Board (NLRB), employers and other stakeholders. The NLRB has reviewed more than 129 cases involving social media in some way. While most of these cases are still at the very initial stages, some are more advanced. The General Counsel has also issued ten memoranda involving social media, eight of which are opinions from the Division of Advice. Please join us for a discussion of the most recent developments in specific labor and employment issues, including use by unions, specific conduct that cannot be prohibited by an employer and use of social media in hiring and firing decisions.
