The Department of Labor has dramatically increased the number of employees who must be paid on an hourly basis. Previously, employees who earned $455 per week (or $23,660 per year) could qualify for exempt status. The DOL's proposed regulations have increased the threshold for exempt status to $970 per week (or $50,440 per year). This increase will cause 120,000 Tennessee employees who have previously been classified as exempt to be non-exempt, meaning they must be paid on an hourly basis and overtime for all hours worked over 40 hours per week.
