Misclassification of employees as independent contractors or as unpaid interns or volunteers can be costly and is the current focus of various state and federal agencies. Hundreds of agents and millions of dollars have been put into this effort. We will examine what can result in individuals you and your Company do not consider as employees being determined as your employees. Closely related, the decision by the NLRB’s General Counsel that McDonald’s and its franchisees are joint employers can have applications beyond the franchise business mode, and we will look at strategies to avoid being considered a joint employer.
