Under Maryland's Workplace Fraud Act, workers in the construction industries are presumed to be employees of the person or business for whom they perform services. However, construction businesses are not required to treat all workers with whom they have a working relationship as employees if the worker is, in fact, an independent contractor under the law.
Hosted by ABC Baltimore, this seminar will discuss who is considered an independent contractor under Maryland law, as well as explore Maryland's independent contractor tests and delve into companies' obligations under the Workplace Fraud Act. Attendees will also receive practical guidance regarding Maryland's new law (SB 853) that holds general contractors strictly liable for their subcontractors' wage and hour violations, which would include worker misclassification.
