With every increasing popularity and use of social media it is important that as advocates we look to the beneficial uses and implications for our clients. We will begin this program with a brief overview and history of Facebook, MySpace, LinkedIn, Twitter and other social networking sites. Following the overview, we will discuss the use of social media as informal discovery tools to benefit your clients' claims using some fact patterns, and we will look at whether the use of such discovery is ethically permitted under recent state and federal case law. In addition, this program will provide practical tips in using social media as an informal discovery tool.
