Professional Biography


In addition, Mr. McJunkin has a national practice representing and protecting creditors' rights in loan workouts, business bankruptcies, foreclosures, and commercial litigation. He offers clients a broad range of services that include negotiating and documenting workout arrangements of complex lending relationships, and helping commercial borrowers in workout negotiations and bankruptcy planning.

Mr. McJunkin's 27-plus years of commercial litigation experience includes prosecuting and defending lawsuits and arbitrations arising out of lending relationships, as well as contractual matters, real estate disputes, franchise issues, title insurance matters, and business torts. He also has considerable experience litigating technology licensing issues, preferences and fraudulent conveyances, and sales of assets and cash collateral matters in the context of Chapter 11 and Chapter 7 bankruptcies.

  • Negotiated treatment of $260 million in secured debt in a proposed pre-arranged plan of reorganization.
  • Lead bankruptcy and litigation counsel on behalf of a securitized loan servicer on $300+ million in loans secured by commercial real estate in multiple states.
  • Lead counsel for vendor financier in Chapter 11 cases of telecommunication companies around the country (California, Washington, D.C., New York, Colorado, Delaware, Arizona and Virginia).
  • Lead lender's counsel on numerous HUD-insured loans involving litigation and bankruptcy related to large apartment complexes in Virginia, Illinois, South Carolina, Connecticut and the District of Columbia.
  • Lead counsel for telecommunications manufacturer in connection with sale of updated telecommunication infrastructure system to Puerto Rican telecom company that filed Chapter 11.
  • Multiple cases representing lenders in the hospitality industry faced with non-performing hotel loans that resulted in receivership litigation, contested foreclosures and litigation of "bad boy" guaranty obligations.
  • Lead counsel on numerous cases involving mediation and alternative dispute resolution where expensive litigation was avoided and favorable outcomes achieved through ADR. 
  • Provided restructuring advice and representation in negotiating and documenting default correspondence and restructuring documents involving a portfolio of loans secured by collateral located in Connecticut. 

  • Advised a large global bank in negotiations to restructure $15 million in loans made to interrelated dental practices in North Carolina. Obtained a loan restructure agreement with a full payoff.
